IntuiBloom Terms of Service

These Terms of Service ("Terms") govern your access to and use of the IntuiBloom website at https://www.IntuiBloom.com (the "Site") and web application (the "App" or "Service"), operated by IntuiBloom ("we," "us," or "our"). The Service allows users to generate, view, interact with, save, share, import, and export AI-generated knowledge graphs. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service is currently in beta and provided on an experimental basis. We may update these Terms from time to time by posting the revised version on the Site. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

1. Description of the Service

The Service enables you to generate knowledge graphs using AI models, view and interact with them, save them to our database (for signed-in users), browse your saved graphs, share via links, import graphs from JSON files, export to JSON, and provide feedback. Generating knowledge graphs is experimental and may produce inaccurate or incomplete results. We employ techniques to reduce misinformation, including transparency on confidence levels, types of confidence (e.g., "Documented fact," "Scientific consensus," "Historical record," "Expert opinion," "Theoretical framework," "Fictional universe," "Speculation," or "Educated guess"), and the basis for confidence. However, AI models have knowledge cutoff dates and may not reflect current events or new facts.

We implement rate limiting: graph generation endpoints allow a maximum of 5 requests per minute per user, and anonymous users are limited in the number of graphs they can generate. The App will notify you if limits are reached and disable generation controls accordingly. Free usage of AI features and data storage may be limited or modified at any time without notice.

The Service is currently free, but we may introduce subscriptions, in-app purchases, or credits in the future for enhanced features, such as larger input limits, higher performance, access to more powerful models, file uploads for graph creation, or web reading capabilities. If implemented, such features will be subject to additional terms.

2. User Accounts and Eligibility

You may use the Service without an account for limited features (e.g., as an anonymous user), but signing up via Clerk (including Google sign-in) is required for saving graphs, browsing history, and other advanced functionalities. You must provide accurate and complete information during registration and keep it updated. There is no verification process, but failure to provide accurate information may result in account suspension.

There are no specific age restrictions beyond those in our Privacy Policy (e.g., not intended for children under 13 or 16 in certain jurisdictions). By using the Service, you represent that you are legally capable of entering into these Terms.

3. User Content and Ownership

"User Content" includes any inputs, generated graphs, imported data, feedback, or other materials you provide or create via the Service.

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, display, reproduce, modify (for technical purposes), and distribute it as necessary to provide and improve the Service, including for quality control, debugging, and anonymized sharing with service providers like OpenAI.

You represent and warrant that your User Content does not infringe third-party rights, including copyrights, and that you have all necessary permissions for any copyrighted material. You must not upload or generate content that is illegal, harmful, or violates these Terms.

4. Intellectual Property

The Service, including its UI, branding, underlying technology, and the AI-generated confidence level system (including outputs related to confidence types and bases), are owned by us and protected by intellectual property laws. You are granted a limited, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service, or use it to create derivative works without our written permission.

5. Prohibited Conduct

You agree not to:

  • Engage in harassment, threats, or abusive behavior toward others.
  • Upload, generate, or share illegal, malicious, defamatory, obscene, or infringing content.
  • Reverse-engineer, decompile, or attempt to extract source code from the Service.
  • Make excessive API calls, bypass rate limits, or use automated tools (e.g., bots) to overload the Service.
  • Use the Service for commercial purposes without our prior written consent.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Transmit viruses, malware, or any code that could harm the Service or users.
  • Violate any applicable laws or regulations.

We may add other prohibitions as needed. Violations may result in immediate termination of your access.

6. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE, OR THAT GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR FREE FROM MISINFORMATION.

AI outputs are experimental and may contain errors, hallucinations, or outdated information. You are responsible for verifying any information before relying on it.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY.

We are not liable for any User Content, including shared or imported content. Our total liability shall not exceed $100 USD.

8. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your User Content, misuse of the Service, or violation of these Terms.

9. Termination

We may suspend or terminate your account and access to the Service at any time, without notice, for violating these Terms or for any other reason. Upon termination, your license to use the Service ends, and we may delete your User Content, subject to applicable laws.

Prior to termination, you may download your content via the "Share Your Knowledge" feature. After termination, you can request a download of your content by emailing [email protected], and we will provide it in a reasonable timeframe. We may implement features allowing limited-time access to download a data dump post-termination.

You may terminate your account at any time by contacting us.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in California, administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in class actions.

11. Updates to Terms

We will notify you of material changes by posting the updated Terms on the Site. Your continued use constitutes acceptance.

13. Miscellaneous

These Terms constitute the entire agreement between you and us, superseding any prior agreements.

If any provision is held invalid or unenforceable, the remaining provisions shall remain in effect.

We are not liable for failures due to events beyond our control (force majeure), such as natural disasters, wars, or pandemics.

You may not assign these Terms without our consent; we may assign them freely.

No waiver of any term shall be deemed a further or continuing waiver.
